Terms of Service
§ 1. Definitions
The terms used in these Terms of Service have the following meanings:
- Service Provider — Aliaksei Lapuka, conducting business activity under the business name Aliaksei Lapuka, ul. Augustyna Szamarzewskiego 21/2, 60-514 Poznań, NIP: 7831854033, REGON: 521561577.
- Platform — the "The Balance Space" mobile application and the thebalance.space website, through which the Service Provider delivers the Services.
- User — a natural person who uses the Platform.
- Account — an individual User profile on the Platform, created upon registration.
- Classes — pilates or other fitness sessions offered through the Platform.
- Pass — a package entitling the User to participate in a specified number of Classes within a defined period.
- Payment Operator — PayNow (mBank S.A., ul. Prosta 18, 00-850 Warszawa), which handles online payments on the Platform.
§ 2. General Provisions
- These Terms of Service set out the rules for using the Platform, including the conditions for booking Classes, making payments, and purchasing Passes.
- By using the Platform, the User accepts these Terms of Service.
- The Service Provider renders services by electronic means in accordance with the Polish Act of 18 July 2002 on the Provision of Electronic Services (Ustawa o świadczeniu usług drogą elektroniczną).
- The Platform is available as a mobile application (iOS, Android) and a website.
§ 3. Registration and User Account
- Registration on the Platform requires providing a mobile phone number or an e-mail address.
- Identity verification is performed using a one-time password (OTP) sent to the provided phone number or e-mail address.
- The User undertakes to provide truthful personal data.
- Each User may hold only one Account on the Platform.
- The User may delete their Account at any time through the application settings. Account deletion is irreversible.
§ 4. Class Bookings
- The User may book Classes through the Platform, provided they have a sufficient number of credits in their Account or an active Pass.
- Bookings can be made within the booking window, the duration of which is determined by the Service Provider (by default, 7 days before the Class).
- Before the booking window opens, the User may sign up for the waitlist.
- The User may enable the auto check-in feature, which automatically books them for selected Classes on specified days of the week.
- The number of places in each Class is limited. Bookings are processed on a first-come, first-served basis.
§ 5. Payments
- Payments for Passes and individual Classes are processed through the Payment Operator — PayNow (mBank S.A.).
- Available payment methods include: bank transfers, BLIK, and payment cards — in accordance with the Payment Operator's offering.
- Prices for Classes and Passes are quoted in Polish zloty (PLN) and include VAT, if applicable. The current price list is available on the Offer & Pricing page.
- Payment is required at the time of booking or purchasing a Pass.
- The service (Pass or individual Class) is activated immediately upon payment confirmation by the Payment Operator. For Passes, the 30-day validity period begins from the moment the payment is recorded.
- The Service Provider issues an electronic transaction confirmation. Transaction history is available in the User's profile within the application.
§ 6. Passes and Packages
- A Pass entitles the User to participate in a specified number of Classes within a defined period (30 days from the activation date).
- A Pass is registered to a specific User and is non-transferable.
- Unused Classes within a Pass do not carry over to the next billing period, unless the terms of a specific Pass provide otherwise.
- Available packages and their prices are published on the Offer & Pricing page and in the The Balance Space application.
- The Service Provider reserves the right to change the price list. Price changes do not affect Passes purchased before the date of the change.
§ 7. Cancellations and Refunds
- The User may cancel a booking free of charge up to 24 hours before the scheduled Class time.
- If a booking is cancelled less than 24 hours before the Class, the funds may not be refunded.
- Refunds for unused Passes are available within 14 days of purchase, provided the User has not attended any Classes under the Pass (right of withdrawal from a distance contract under the Polish Act of 30 May 2014 on Consumer Rights — Ustawa o prawach konsumenta).
- In the event of a justified complaint, a refund is made to the account from which the payment was made, within 14 business days.
- To submit a refund request, the User should contact the Service Provider at: thebalancespacehq@gmail.com.
§ 8. Liability
- The Service Provider makes every effort to ensure the Platform operates correctly and without interruption.
- The Service Provider is not liable for interruptions in the Platform's operation caused by circumstances beyond its control, including technical infrastructure failures.
- The User participates in Classes at their own risk. The Service Provider recommends consulting a physician before commencing physical activity.
- The Service Provider is not liable for damages resulting from use of the Platform in a manner inconsistent with these Terms of Service.
§ 9. Personal Data Protection
- The controller of Users' personal data is the Service Provider.
- Personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and the Polish Act on Personal Data Protection.

§ 10. Complaints
- The User has the right to file a complaint regarding the operation of the Platform or the services provided.
- Complaints should be sent to the e-mail address: thebalancespacehq@gmail.com.
- A complaint should include: the User's full name, the e-mail address associated with the Account, a description of the issue, and the expected resolution.
- The Service Provider will review the complaint within 14 days of receipt and will inform the User of the outcome by electronic means.
§ 11. Out-of-Court Dispute Resolution
- Consumers have the right to use out-of-court dispute resolution methods, including mediation or arbitration.
- Detailed information is available on the website of the Polish Office of Competition and Consumer Protection (Urząd Ochrony Konkurencji i Konsumentów): www.uokik.gov.pl.
- Consumers may use the EU Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr.
§ 12. Final Provisions
- The Service Provider reserves the right to amend these Terms of Service. Users will be notified of any changes through the Platform at least 14 days in advance.
- Matters not covered by these Terms of Service are governed by Polish law.
- These Terms of Service enter into force on 1 March 2026.
